radioBee - Terms and Conditions

License Grante. radioBee grants to you a limited, non-exclusive, non-transferable license to access and use the radioBee for personal non-commercial purposes only. If you subscribe to any of the radioBee Services, this license is contingent upon your payment of any applicable subscription fees and your compliance with any other terms and conditions applicable to you as a subscriber. Any violation by you of the license provisions may result in the immediate termination of your right to use the radioBee Services. radioBee reserves all right, title and interest not expressly granted under this license to the fullest extent possible under applicable laws. ANY USE OF THE radioBee SERVICES NOT SPECIFICALLY PERMITTED UNDER THIS AGREEMENT IS STRICTLY PROHIBITED.

radioBee may from time to time make available to some or all users of the radioBee Services, updates at no cost or subject to additional fees in radioBee's sole discretion. "Updates" means any updates, upgrades or error corrections to the radioBee Services that radioBee makes available generally to users of the radioBee Services. Notwithstanding anything else contained in this Agreement, radioBee will have no obligation to continue producing or releasing new versions of the radioBee Services or any updates thereto.

The following are registered trademarks or trademarks or patents of radioBee: radioBee, and its design logo, as well as certain other radioBee trademarks, service marks, graphics, logos, methods (collectively, the "radioBee Trademarks and methods") used in connection with the radioBee applications and services. The radioBee Services may contain third-party trademarks, service marks, graphics, and logos. You are not granted any right or license with respect to radiobee Trademarks or the trademarks of any third party.

radioBee does not actively monitor stream contents and listening to all content broadcast is the sole responsibility of the client. Broadcasting the content is a sole reposnsibility ot the broadcaster, under Shoutcast terms of conditions

We do not provide any form of legal cover to individuals or companies who utilize our services to distribute content with any copyright protection.

Under no circumstances will radioBee be responsible for the behaviour of the broadcasters or their users when found to be broadcasting protected content. All licensing, copyright and royalty issues are the sole responsibility of the broadcasters and/or their production entities.

radioBee will make every effort possible to ensure security of client's data, however due to the large volume of media broadcasted and the nature of the Internet, all data is stored at clients own risk and we will assume no responsibility for any loss, damage , misleading use, or leakage of cleent's data. We can't be responsible for what happens to that information.

You agree that radioBee can use your registration, your activity data, and usage data for different advertising purposes and marketing purposes. When you use the program, you may see ads and receive promotion notifications. You may receive promotional e-mails or messages as well.

You need to be at least 13 years old to use radioBee.

You have no right to distribute radioBee or use the radioBee logos and trademarks, unless we have a signed written distribution agreement.

We expect you to keep your registration number and password to yourself.

radioBee is for personal use only, that means you can't play radioBee for the patrons in your bar, coffee shop, etc.

You can't use radioBee to steal music, and you have to listen to it through a device officially supported by radioBee.

We make a lot of effort to provide you radioBee versions which will work on most of the devices which should be compatible. However, because of the variety of the devices, manufacturers, carriers, OS builds, nature of internet connectivity and wireless connectivity, we can not guarantee that all features will work on all devices. We provide radioBee to you to use it on "AS-IS" basis, without any warranty of any kind, either expressed or implied, including but not limited to the impled warranties of mechantability and/or fitness for a particular purpose.

radioBee MAKES NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES THAT USE OR RESULTS OF THE USE OF THE radioBee SERVICES WILL BE ACCURATE, RELIABLE, CURRENT, UNINTERRUPTED OR WITHOUT ERRORS. WITHOUT PRIOR NOTICE, radioBee MAY MODIFY, SUSPEND, OR DISCONTINUE THE radioBee SERVICES (INCLUDING ANY CONTENT) OR YOUR USE OF THEM. WHENEVER radioBee and Smart Mobile Solutions ELECT TO MODIFY, SUSPEND, OR DISCONTINUE THE radioBee SERVICES, IT WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY

YOU UNDERSTAND THAT YOU MAY ENCOUNTER OFFENSIVE, INDECENT OR OTHER OBJECTIONABLE CONTENT WHEN USING THE radioBee SERVICES. radioBee and Smart Mobile Solutions WILL HAVE NO LIABILITY TO YOU FOR ANY SUCH CONTENT.

IN NO EVENT WILL radioBee or Smart Mobile Solutions BE LIABLE TO YOU FOR INDIRECT, GENERAL, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, CORRUPTION OF FILES, LOSS OF BUSINESS INFORMATION OR ANY OTHER PECUNIARY LOSS) EVEN IF radioBee HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY radioBee OR OTHERS WILL CREATE A WARRANTY AND NEITHER YOU NOR ANY THIRD PARTY MAY RELY ON ANY SUCH INFORMATION OR ADVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY OR MAY NOT APPLY TO YOU.

radioBee'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER THIS AGREEMENT WILL BE LIMITED TO THE GREATER OF ONE DOLLAR (US $1.00) OR THE TOTAL AMOUNT PAID BY YOU FOR THE APPLICABLE radioBee SERVICES AT ISSUE.

YOU WILL INDEMNIFY AND HOLD radioBee or Smart Mobile Solutions, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS HARMLESS WITH RESPECT TO ANY SUITS OR CLAIMS ARISING OUT OF (I) YOUR BREACH OF THIS AGREEMENT, INCLUDING, BUT NOT LIMITED TO, ANY INFRINGEMENT BY YOU OF THE COPYRIGHT OR INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY; OR (II) YOUR USE OF THE radioBee SERVICES.

Do not use radioBee if you do not agree to the Terms of Use. Your use of radioBee means you agree to the Terms of Use.
